Terms and Conditions

These Terms govern your use of MicrobiomeTest.ca and your purchase and use of microbiome test kits, laboratory testing services, reports and related support.

By using this website or placing an order, you agree to these Terms. If you do not agree, do not place an order or submit a biological sample.

Important consumer-rights notice

Nothing in these Terms excludes, restricts or replaces a right, remedy, warranty or protection that cannot lawfully be excluded under applicable federal, provincial or territorial law.

If a provision of these Terms conflicts with a mandatory consumer-protection requirement, the mandatory requirement will apply to the extent of the conflict.

1. About these Terms

Website use

These Terms apply when you browse the website, read educational content, submit a form, communicate with support or access an online report.

Orders and kits

They also apply when you order a kit, receive collection materials, register a test, submit a sample or request laboratory processing.

Related policies

The applicable product page, order confirmation, shipping policy and privacy policy form part of the information governing your purchase.

2. Operator and laboratory providers

Microbiome Test Canada is operated by Cansoft Technologies Corp. In these Terms, “Microbiome Test Canada,” “we,” “us” and “our” refer to the website operator.

We may use contracted laboratories, couriers, payment processors, hosting providers and other service providers to fulfil an order and provide the testing service.

Information and samples will only be shared with service providers as reasonably necessary to perform the service, fulfil the order, meet legal obligations or as otherwise described in our Privacy Policy.

Unless clearly stated otherwise, a contracted laboratory or courier is not the seller of the test kit to you.

3. Eligibility, authority and consent

Age and capacity

You must have reached the age of majority in your province or territory and have legal capacity to place an order.

Your own sample

You may submit your own sample when you understand the test and voluntarily consent to the collection and analysis described in the kit instructions.

Another person’s sample

You must not submit another person’s sample unless you have lawful authority and all consent required to order the test and authorize processing.

When a participant is a minor or cannot legally provide consent, the person ordering must be legally authorized to act for that participant. We may request proof of identity, authority or consent before accepting or processing a sample.

Samples submitted without adequate authorization or consent may be refused, returned where appropriate or securely disposed of.

4. Educational service—not medical diagnosis

The website, test report, report preview, educational explanations and general support information are provided for informational and educational purposes.

The test is not intended to diagnose, treat, cure or prevent disease and is not a substitute for an examination, diagnosis, treatment plan or other advice from a qualified healthcare professional.

Do not stop or change medication, delay medical care, begin a restrictive diet or make a treatment decision solely because of website content or a microbiome report.

Seek appropriate professional care for severe, persistent, worsening or otherwise concerning symptoms.

5. Orders and contract formation

Product descriptions, prices, available services, estimated turnaround periods and kit contents are displayed on the applicable product or order page.

Before submitting an order, you are responsible for reviewing the product, participant information, delivery address, price, taxes, shipping charges, currency and other order details.

You must have an opportunity to correct mistakes before completing payment.

An automated acknowledgement confirms that we received your order. We may still need to verify payment, availability, delivery access, participant eligibility or order information before accepting it.

We may decline or cancel an order before processing when there is a pricing or description error, suspected fraud, unavailable service, delivery restriction, legal concern or other reasonable operational issue. If we cancel an order after receiving payment, the affected amount will be refunded unless the law permits otherwise.

6. Prices, taxes and payment

Displayed currency

The currency displayed during checkout applies to the order. Applicable taxes, shipping charges and other disclosed costs will be shown before payment.

Payment authorization

By providing a payment method, you confirm that you are authorized to use it and authorize the stated charge.

Payment providers

Payments may be processed by a third-party payment provider. Its processing terms and privacy practices may also apply.

7. Shipping and delivery

Shipping methods, charges, service areas and available courier options are described on the Shipping and Delivery page and during checkout.

Delivery and sample-return estimates may be affected by location, carrier operations, weather, holidays, customs requirements, service interruptions and other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address, email address and telephone number.

Additional shipping charges may apply when a package must be sent again because of an incorrect address, refusal, failure to collect or another issue attributable to the recipient, except where prohibited by law.

Laboratory turnaround does not include the time used to deliver the kit to you or return the sample to the laboratory.

8. Sample collection and return

Follow the instructions

Read the complete collection and return instructions before opening collection materials or collecting a sample.

Use the correct materials

Use only the collection container, labels, packaging and return address supplied or approved for the test.

Return the sample promptly

Package and return the sample within the timeframe and under the conditions stated in the kit instructions.

Do not submit a sample that is prohibited by law, collected without consent, incorrectly labelled, visibly leaking or inconsistent with the test instructions.

When tracking is available, retain the mailing receipt and tracking information until laboratory delivery is confirmed.

9. Samples that cannot be processed

A sample may be unsuitable for analysis because it is insufficient, damaged, contaminated, incorrectly collected, incorrectly labelled, received outside an acceptable timeframe or otherwise does not meet laboratory requirements.

If processing fails because of a confirmed laboratory error or omission, an appropriate retest or recollection will normally be arranged without an additional testing fee.

If processing fails because the collection instructions were not followed, the sample was unsuitable for reasons outside laboratory control or a replacement kit is required, a recollection, replacement, laboratory or shipping charge may apply.

We will explain the available option and any applicable charge before proceeding.

10. Laboratory processing and turnaround

A stated turnaround period is an estimate unless it is expressly described as guaranteed.

Laboratory turnaround begins after the sample reaches the correct laboratory, is matched to the order and is accepted as suitable for processing.

Processing may take longer because of sample quality, repeat analysis, quality-control review, laboratory workload, equipment issues, supply interruptions, holidays, carrier delays or other circumstances.

We will provide reasonable updates when we become aware of a material processing delay.

11. Reports and interpretation

Snapshot in time

A microbiome result reflects the submitted sample and the methodology used at the time of analysis.

Natural variation

Diet, medication, antibiotics, supplements, illness, travel, collection timing and other factors may affect microbiome patterns.

No guaranteed outcome

We do not guarantee that a report will answer every question, explain a symptom or lead to a particular health outcome.

Report categories, reference information, recommendations and presentation methods may change as laboratory methods, databases and reporting practices develop.

Review the sample report and results information before ordering.

12. Cancellations, refunds and order changes

Request changes promptly

Contact support immediately if you need to correct, change or cancel an order. A change cannot be guaranteed after processing or dispatch begins.

Order status matters

Refund eligibility may depend on whether payment has been processed, the kit has been prepared or dispatched, the kit has been registered, a sample has been used or laboratory work has begun.

Mandatory rights remain

Any statutory cancellation, refund, replacement or charge-reversal right available under applicable consumer law remains unaffected.

A damaged, incomplete or incorrect kit should be reported promptly. Include the order number, delivery details, description of the problem and photographs where appropriate.

Approved refunds are returned to the original payment method unless another method is required or agreed. Bank and card-processing times are outside our control.

Commercial refund decisions do not limit remedies available for defective goods, misrepresentation, non-delivery or another situation covered by applicable law.

13. Your responsibilities

  • Provide accurate order, contact, participant and delivery information.
  • Review the product details and report limitations before ordering.
  • Obtain all legally required consent and authorization.
  • Follow the collection, labelling, storage and shipping instructions.
  • Protect your order number, account credentials and report-access information.
  • Contact support promptly when information is incorrect or a problem occurs.
  • Use the report responsibly and seek professional medical advice when appropriate.

14. Privacy and electronic communication

Personal information

Personal, order, participant, sample-related and report information is handled as described in our Privacy Policy.

Service providers

Relevant information may be processed by laboratories, couriers, payment providers and technology providers involved in delivering the service.

Electronic delivery

You agree to receive order confirmations, shipping notices, sample updates, reports and support messages electronically at the address you provide.

You are responsible for protecting access to your email account and any portal or report link. Notify us promptly if you believe access has been compromised.

Marketing communications, where used, are separate from service messages and are subject to applicable consent and unsubscribe requirements.

15. Intellectual property

Unless otherwise stated, the website design, text, graphics, photographs, educational materials, report examples, branding and other website content are owned by or licensed to Cansoft Technologies Corp.

You may access and print reasonable portions for personal, non-commercial use.

You may not reproduce, republish, sell, scrape, systematically download, modify, distribute or commercially exploit website content without prior written permission, except where applicable law permits it.

16. Acceptable website use

No interference

Do not disrupt the website, overload its infrastructure, introduce malicious code or attempt unauthorized access.

No impersonation

Do not impersonate another person, submit false information or use another person’s payment or account details without authorization.

No unlawful use

Do not use the website, kit, report or support service for an unlawful, fraudulent or abusive purpose.

17. Third-party websites and services

The website may link to third-party websites, payment services, courier tools, laboratory portals or educational sources.

A link does not necessarily mean that we control or endorse every statement, product, security practice or policy of the third party.

Third-party services may be governed by separate terms and privacy policies. Review those terms before providing information directly to the third party.

18. Disclaimers

Website availability

We do not guarantee uninterrupted, error-free or continuously available access to the website, portal or electronic report.

Scientific development

Microbiome research, databases and interpretation methods continue to develop. Educational interpretations may change over time.

External factors

We cannot guarantee the performance of postal services, couriers, internet providers or other systems outside our reasonable control.

19. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss arising from website use, shipping delays, misuse of a kit, unauthorized sample submission or reliance on educational report information.

To the maximum extent permitted by applicable law, our total liability arising from an affected order or testing service will not exceed the amount you paid for that affected order or service.

These limitations do not apply where liability cannot lawfully be excluded or limited, including any applicable liability for fraud, wilful misconduct, gross negligence, personal injury, breach of mandatory consumer guarantees or another non-waivable legal obligation.

20. Events outside reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, natural disaster, fire, flood, epidemic, labour disruption, carrier interruption, border or customs delay, government action, laboratory closure, equipment failure, cyber incident, utility interruption or shortage of essential materials.

We will take reasonable steps to reduce the effect of the event and resume the affected service when reasonably possible.

This clause does not remove any cancellation, refund or other right that applicable law provides because goods or services were not supplied.

21. Changes to these Terms

We may update these Terms to reflect changes in law, website functions, products, laboratories, payment systems, shipping processes or business operations.

The effective date at the top of the page will be updated when material changes are published.

Unless applicable law requires otherwise or you expressly agree, a later version will not retroactively change the material terms of an order already accepted.

The version available when you place an order should be retained with your order confirmation.

22. Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without giving effect to conflict-of-law rules.

This choice of law does not deprive you of mandatory consumer protections that apply in your province or territory of residence.

Before beginning formal proceedings, you and Microbiome Test Canada should make reasonable efforts to resolve the issue through written communication.

Subject to any mandatory right to bring a claim elsewhere, legal proceedings may be brought before a court of competent jurisdiction in British Columbia.

23. General provisions

Entire agreement

These Terms, the applicable order confirmation, product details and incorporated policies form the agreement relating to the affected purchase.

Severability

If a provision is invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue.

No waiver

A delay in enforcing a provision does not waive the right to enforce it later.

Assignment

You may not transfer an order or your rights under these Terms without our consent. We may transfer business obligations as part of a lawful restructuring, sale or service-provider change, subject to applicable privacy and consumer law.

24. Contact information

Questions, cancellation notices, address corrections, complaints and legal notices should include your name, order number, contact information and a clear description of the request.
